1. Eligibility and Acceptance of Terms

  • You must be at least 18 years old to use the services provided through this Site.
  • If you are under 18, you are strictly prohibited from registering, accessing, or using the Site in any manner that misrepresents your age.
  • By using this Site, you confirm that you meet the legal age requirement and are eligible to enter into a binding contract with the Company.
If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site.

2. Definitions

  • "Company," "we," "our," or "us" refers to Continual Engine.
  • "User," "you," or "your" refers to any person or entity accessing our services.
  • "Services" refer to all digital accessibility solutions and services offered by Continual Engine.

3. User Conduct

By using the Site, you agree to adhere to the following User Conduct Guidelines and not to host, display, upload, modify, publish, transmit, update, or share any content that:
  • Belongs to another person without having the necessary rights or permissions.
  • Is harmful, harassing, defamatory, obscene, pornographic, pedophilic, libelous, invasive of privacy, hateful, or racially or ethnically objectionable.
  • Promotes, encourages, or relates to money laundering, gambling, or any unlawful activity.
  • Harms minors in any way.
  • Infringes any intellectual property rights, including patents, trademarks, or copyrights.
  • Violates any applicable law in any jurisdiction.
  • Impersonates another person or misrepresents your affiliation with any individual or entity.
  • Contains viruses, malware, or any malicious code designed to disrupt, damage, or limit the functionality of any software, hardware, or electronic device.
  • Threatens public order, incites criminal activity, prevents law enforcement investigations, or insults any nation.
Failure to comply with these guidelines may result in immediate suspension or termination of access to the Site and possible legal action.

4. Use of Services

  • You agree to provide accurate and complete information when using our services.
  • You must not use our services for unlawful, fraudulent, or abusive purposes.
  • We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

5. Request Modifications

  • The Company understands that accessibility interpretations may vary. To address this, the Site provides a "Request for Modification" option.
  • If an order has been delivered/completed, Users may request a modification within 3 working days of the delivery date (i.e., the date when the Company’s intimation is sent to the User).
  • Requests for modifications will be considered only if they relate to:
  • Alternate text for images, or
  • Tag structure of the document.
  • The Company will provide one round of iterative changes without additional charges.
  • All modification requests will be delivered within 2 working days from the date of acceptance.

6. Estimated Date of Delivery

  • The Estimated Date of Delivery is calculated based on document type, size, and the delivery option chosen by the User.
  • If a document cannot be delivered on the specified date due to unforeseen challenges, the Company reserves the right to notify the User of the revised delivery date.

7. Document Copyright & Ownership

  • The Company does not verify the ownership or intellectual property of the submitted document.
  • All accessible versions of uploaded documents delivered by the Company will be deemed a "work made for hire."

8. Cancel a Subscription

  • A User may cancel a subscription at any time.
  • If a subscription is canceled, the User’s Wallet Credits will remain unchanged.

9. Clarification from User

  • The Company strives to meet accessibility requirements. However, if clarifications are required, the Company reserves the right to seek clarifications from the User.
  • If delays occur due to awaiting User input, the estimated delivery date may change, and the User will be notified accordingly.

10. Availability, Errors, and Inaccuracies

  • The Company frequently updates its products and support services. However, some products or services may be mispriced, inaccurately described, or unavailable.
  • The Company does not guarantee the accuracy or completeness of the information provided on the Site.
  • The Company reserves the right to change or update information at any time without prior notice.

Service Availability and Connectivity Issues

  • Due to high internet traffic, system capacity limitations, or technical issues, you may experience difficulty accessing the Site.
  • The Company does not guarantee uninterrupted access to the Site.

11. Accessibility Compliance & Legal Responsibility

  • Our services follow industry-standard accessibility guidelines, including WCAG (Web Content Accessibility Guidelines) where applicable.
  • While we strive to enhance accessibility, we do not guarantee full compliance with accessibility laws, regulations, or standards.
  • Legal Disclaimer: Continual Engine is not responsible for any legal consequences arising from accessibility compliance issues. It is the customer’s responsibility to ensure their content meets regulatory requirements.

12. Payment, Refunds & Cancellation Policy

Payment Terms: All fees must be paid in full before service completion.
Refund Policy:
  • No refunds will be issued.
Cancellation Policy:
  • Users may cancel subscriptions or reservations under specific conditions outlined at the time of purchase.
  • If a subscription is canceled before the renewal date, access to services will continue until the end of the billing cycle.
Currency for Transactions: All payments will be conducted in USD ($) or the currency specified at the time of purchase.

13. Limitation of Liability

  • While we strive for accuracy and high-quality services, we do not guarantee perfection or complete compliance with accessibility standards.
  • The Company is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.
  • We do not provide legal, financial, or compliance advice, and any reliance on our services is at your own discretion and risk.

14. Termination of Services

  • We reserve the right to suspend or terminate services for users who violate these terms.
  • Users may discontinue using our services at any time.
  • Termination of services does not entitle users to a refund, except as outlined in the refund policy.

15. Updates & Changes to Terms

  • We reserve the right to update or modify these Terms at any time.
  • By continuing to use our services after updates, you agree to the revised Terms.
  • If you do not accept the revised Terms, you must discontinue use of the Services.

16. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the State of Texas, USA.
  • Any disputes or claims must be resolved in accordance with local laws and regulations applicable in the specified jurisdiction.
